Judgments on Grave Space Reservations

Judgments on Grave Space Reservations

2025-12 Ellastone St Peter Rejection of a private petition for the reservation of a grave space. The reservation was not supported by the Parochial Church Council, which had a policy against reservations (although one grave was reserved in the churchyard for reasons which were unclear). The churchyard was expected to be full within about 12 years. Having due regard to the policy and vote of the PCC, and the limited space in the churchyard, the petition was refused.

2024-09 September: Fazeley St Paul Hudson

The Deputy Chancellor granted a faculty for the reservation of a grave space for the period of 15 years in accordance with the approach set out at [32] of St Mary, Thame (and adopted in this Diocese by Chancellor Verduyn in St Mark’s, Ocker Hill [2022] ECC Lic 4)

2024-09 September: Fazeley St Paul Timms

The Deputy Chancellor granted a faculty for the reservation of a double depth grave space for the period of 50 years usually allowed.

2022-06 June: Tipton Ocker Hill St Mark

The Deputy Chancellor granted a faculty for the reservation of a double depth grave space for the period of 50 years usually allowed. He distinguished this case from Re St. Mark Ocker Hill Tipton [2022] ECC Lic 4, where he limited the reservation for 20 years, because the graveyard could be full and closed before a longer reservation would need to be exercised; in the present case, one of the joint petitioners was terminally ill, so that the double plot would be in use quite soon.
