In this section we provide some useful information concerning the procedures under the Clergy Discipline Measure 2003. In particular we provide a copy of the leaflets designed to assist Complainants and Respondents, and of the Code of Practice to which all those involved in the Measure must have regard. The Measure provides a process for the resolution of serious matters of misconduct.
More information is available from the Church of England's web site. That web site includes a section on the ecclesiastical legal aid that may be available to members of the clergy facing Complaints under the Measure here.
In accordance with guidance issued by the Clergy Discipline Commission under section 3(3)(b) of the Clergy Discipline Measure (CDM) and paragraph 265 of the Code of Practice, a Register of Penalties imposed by the Diocesan Bishop in cases where there has been no Tribunal hearing is kept for the Bishop by the Diocesan Registrar. This is not a public register but some information within it can be accessed by those with a legitimate interest in a particular case upon application to the Diocesan Registry: andrew.wynne@fbcmb.co.uk
Records of Tribunal decisions can be accessed on the Church of England website available here.
